ProfitMode provides cloud-based accounting and bookkeeping software designed for small businesses, freelancers, and startups. The Service includes features such as:

• Double-entry bookkeeping and general ledger
• Invoice and bill management
• Bank account connectivity via Plaid
• Payment processing via Stripe
• Payroll integration via Gusto
• Financial reporting (Profit & Loss, Balance Sheet, Cash Flow)
• Dashboard metrics and analytics

3. Important Disclaimer: Not Tax or Legal Advice

We make no warranties or representations regarding the accuracy, completeness, or suitability of any financial reports or calculations generated by the Service for tax filing or regulatory compliance purposes.

4. User Accounts and Security

To use the Service, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be at least 18 years old or have parental consent

You are responsible for all activities that occur under your account. We recommend enabling two-factor authentication for enhanced security.

5. Third-Party Integrations

The Service integrates with third-party services including but not limited to:

• Plaid - For bank account connectivity and transaction imports
• Stripe - For payment processing and invoicing
• Gusto - For payroll data synchronization
• Firebase - For authentication and data storage

Your use of these integrations is subject to the respective third-party terms of service and privacy policies. We are not responsible for the actions, content, or data handling practices of third-party services.

6. Data Ownership and Privacy

You retain ownership of all data you input into the Service. By using the Service, you grant us a limited license to process, store, and display your data as necessary to provide the Service.

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or to violate any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Upload malicious code or content
• Use the Service to transmit spam or unsolicited communications

8. Subscription and Billing

Some features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date.

We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROFITMODE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

11. Indemnification

You agree to indemnify, defend, and hold harmless ProfitMode and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data before termination.

You may cancel your account at any time through the account settings or by contacting support.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Fulton County, Georgia.
